2.1 Age Verification

You must be at least 21 years of age (or 18+ with a valid medical recommendation where applicable under state law) to access or use our Services. By using our Services, you represent and warrant that:

• You meet the minimum age requirement in your jurisdiction
• It is legal for you to view cannabis-related educational content in your location
• You will not allow any person under the legal age to access our Services using your account

2.2 Geographic Restrictions

Our Services are available only where cannabis education and information is legally permitted. By accessing our Services, you confirm that:

• Accessing cannabis-related educational content is legal in your jurisdiction
• You will not use our Services in any jurisdiction where such use is prohibited
• You understand that cannabis remains illegal under U.S. federal law and in many jurisdictions worldwide

2.3 Compliance Responsibility

You are solely responsible for ensuring your use of our Services complies with all applicable local, state, federal, and international laws. We make no representations that the content or Services are appropriate or available for use in all locations.

All content provided through our Services is for educational and informational purposes only. Our Services are designed to educate users about cannabis strains, effects, and science, help users track and understand their personal cannabis experiences, and provide research-backed information about cannabis compounds.

4.4 Federal Law Acknowledgment

As of December 2025, cannabis (marijuana) rescheduling from Schedule I to Schedule III is in progress under the U.S. Controlled Substances Act. An Executive Order was issued on December 18, 2025 directing expedited rescheduling, but the regulatory process is ongoing. While many U.S. states have legalized cannabis for medical and/or recreational use, federal law continues to evolve. Even if rescheduled to Schedule III, cannabis would remain a controlled substance requiring compliance with federal regulations.

6.1 Account Creation (High IQ App)

To use the High IQ App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities that occur under your account

6.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent or abusive activity, extended period of inactivity, or any reason at our sole discretion.

You may delete your account at any time through the app settings.

8.1 Our Intellectual Property

The Services and all content, features, and functionality are owned by TIWIH and protected by copyright, trademark, patent, trade secret, and other intellectual property laws. This includes website design, mobile app code, "Professor High" character and branding, proprietary algorithms and AI systems, and original content.

8.2 Open Source Strain Data

Strain information data (strain names, effects, terpenes, cannabinoids) is provided as open-source educational content. However, the presentation, organization, and AI-enhanced analysis of this data remain our intellectual property.

8.3 Limited License to Users

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not copy, modify, distribute, reverse engineer, or use our Services for commercial purposes without written permission.

8.4 Trademarks

"This Is Why I'm High," "TIWIH," "High IQ," "Professor High," and associated logos are trademarks. You may not use these marks without our prior written consent.

You agree not to use our Services for:

10.1 Illegal Activities

• Violate any local, state, federal, or international law
• Facilitate illegal cannabis sales, distribution, or trafficking
• Purchase, sell, or transfer cannabis through our platform
• Provide cannabis to minors or unauthorized individuals

10.2 Harmful Activities

• Transmit viruses, malware, or malicious code
• Interfere with or disrupt the Services or servers
• Attempt to gain unauthorized access to systems or user accounts

10.3 Misuse of Content

• Scrape, crawl, or systematically extract data without permission
• Reproduce content for commercial purposes
• Misrepresent your affiliation with us

10.4 Misrepresentation

• Impersonate any person or entity
• Provide false information during registration
• Circumvent age verification requirements

12.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at hello@thisiswhyimhigh.com to seek informal resolution. We will attempt to resolve the dispute informally within 30 days.

12.2 Binding Arbitration

If informal resolution fails, any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules.

12.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.

12.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.

12.5 Venue

For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.
